Terms of Service

Terms for the use of Gobi Stories' services and tools for video production and distribution.

1 Introduction

Gobi Stories AS (“Gobi Stories”, “Gobi”, “we”, “us”) delivers services to create and distribute video in the story format. The Service consists of:

  • Gobi Studio — where users edit, manage and publish content.
  • Gobi Autopilot — where employees record themselves and submit content that is edited and delivered to the Customer.
  • Gobi Player — a video player for publishing content on websites, career pages, job listings and other integrated systems.

These Terms of Service regulate Gobi's provision of the Service and the Customer's use of it. The Service is offered to businesses and other legal entities. By registering an account or using any of the Service, the Customer accepts these Terms, the Privacy Policy and the Data Processing Agreement (DPA), which together constitute a binding agreement between the Customer and Gobi.

2 Your Account

The Customer may create an account to use the Service by registering an email address and password. The Customer must provide accurate and up-to-date information and keep its account details current.

The Customer is responsible for maintaining the confidentiality of login information, for not sharing it with unauthorized parties, and for all activity under its account. If the Customer becomes aware of unauthorized access, it shall change its password and notify Gobi without undue delay.

Users of the Service must be at least 18 years old.

3 Ownership

Except for content uploaded by the Customer, Gobi owns all intellectual property and rights in the Service. No part of the Service, including logos, design and graphics, may be reproduced, copied, sold or resold without the prior written consent of Gobi.

4 Grant of rights to use Gobi

Subject to acceptance of and compliance with this Agreement, Gobi grants the Customer a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to access and use the Service solely in accordance with these Terms.

Any new features that enhance the Service shall be subject to this Agreement. The Customer may not allow unauthorized third parties to access the Service, or assign or transfer its account to any other person or third party.

The Customer shall comply with these Terms and all applicable laws in connection with its use of the Service, and shall use the Service only for lawful purposes.

5 Content you upload

Any content provided by the Customer remains the Customer's property. The Customer may not upload pictures or videos of individuals without their consent, or content that infringes any third party's intellectual property rights, privacy rights or rights of publicity. The Customer is responsible for obtaining all necessary consents prior to uploading.

The Customer shall not upload content that is unlawful, defamatory, hateful, violent, obscene, pornographic, or otherwise offensive. Gobi reserves the right to remove, at its sole discretion and without prior notice, any content that violates these Terms.

6 Use of Customer name and logo

Unless the Customer has opted out in writing, Gobi is granted a limited, non-exclusive, royalty-free license to use the Customer's name and logo in Gobi's own marketing, including its website, social media, case studies and sales materials. The Customer may revoke this permission at any time by written notice to contact@gobistories.com. Gobi shall remove such use from future marketing within a reasonable time. Materials already published do not need to be recalled, but shall not be reused after revocation.

7 Payment and plans

Gobi offers free and paid subscription plans. By purchasing a paid subscription, the Customer accepts the terms and pricing of the chosen plan. Paid subscriptions are invoiced in advance.

Upon upgrade during an ongoing subscription period, the Customer is invoiced on a pro-rata basis for the difference between the new and the existing plan for the remainder of the period.

Current prices for available plans are published at gobistories.com/en/pricing. Price changes upon renewal shall be notified to the Customer in writing at least 90 days before the renewal date.

If the Customer fails to pay for a purchased subscription, Gobi may suspend or terminate the Service.

8 Cancellation

Paid subscriptions renew automatically for equivalent periods (monthly or annual) unless terminated in accordance with this section.

Monthly subscriptions may be cancelled at any time, with effect from the end of the current monthly period. Annual subscriptions may be cancelled with at least 90 days' written notice before the renewal date. Cancellation is made through Gobi Studio or by email to contact@gobistories.com.

Prepaid amounts are not refunded, except where Gobi has materially breached the Agreement and failed to remedy the breach within 30 days after written notice.

9 Data protection

Gobi's processing of personal data is described in the Privacy Policy. Where Gobi processes personal data on behalf of the Customer, the relationship is governed by the Data Processing Agreement (DPA), which forms an integral part of the Agreement.

The Customer is the data controller for personal data processed through the Service on the Customer's behalf, including content uploaded to Gobi Studio, recordings collected through Gobi Autopilot, and end user connection data processed by Gobi Player. Gobi acts as data processor in respect of such processing.

10 Disclaimer

The Service, including all tools and features, is provided “as is”, “at your own risk” and “as available”, without any warranty, express or implied. Gobi assumes no responsibility for the accuracy or completeness of the Service or any material made available through it. Gobi does not warrant that the Service will meet the Customer's requirements, or that the operation of the Service will be uninterrupted or error free.

All other warranties, express or implied, including any warranties of merchantability, fitness for any particular purpose, or non-infringement of intellectual property, are specifically excluded and disclaimed.

11 Limitation of Liability

Gobi shall not be liable for indirect damages, including lost profits, lost data, business interruption, or other consequential damages resulting from the Customer's use of the Service or inability to access or use the Service.

Each party's aggregate liability under the Agreement (including the DPA) is limited to 75% of the fees paid by the Customer to Gobi during the twelve (12) months preceding the event giving rise to the claim.

The limitations in this section do not apply to damages caused by gross negligence or willful misconduct, or to liability that cannot be limited under mandatory applicable law.

12 Indemnity

The Customer agrees to indemnify and hold Gobi and its affiliates, directors, employees, and agents harmless from any and all claims, losses, liabilities, and expenses (including reasonable attorney fees), arising out of or in connection with (i) content uploaded by the Customer, (ii) the Customer's breach of this Agreement, or (iii) the Customer's violation of applicable law, including data protection and marketing regulations.

13 Term and Termination

This Agreement commences upon acceptance of these Terms and continues until terminated in accordance with this section.

The Customer may terminate the Agreement by closing its account or by contacting Gobi at contact@gobistories.com.

Gobi may terminate the Agreement with immediate effect if the Customer materially breaches these Terms and fails to remedy the breach within 30 days after written notice.

14 Notices and Updates

Gobi may change these Terms. Material changes shall be notified to the Customer in writing. Continued use of the Service after such notice constitutes acceptance of the revised Terms. The Customer may terminate the Agreement in accordance with section 13 if it does not accept a material change.

15 Choice of law and jurisdiction

These Terms shall be governed by the laws of Norway. Any disputes shall first be sought resolved amicably by email to contact@gobistories.com. Failing amicable resolution, Oslo District Court is agreed as the venue.
